By using this website (“Site”), whether for purposes of viewing or ordering house plans (“Plans”), you acknowledge that you have read and understood, and agree to these Terms and Conditions (“Terms”).

Your Privacy. Your use of this Site is subject to Ideal House Plans (“IHP”)’s privacy policy, the provisions of which are incorporated into these Terms. Copyright and Licensing. IHP owns the copyright to the Plans found on this Site. Click here for more copyright information.

When you order Plans from this Site, IHP licenses rights to use these Plans directly to you (“License”). The License grants you the right to use the Plans to construct a single structure. You may not re-use the Plans (i.e. for building additional homes) without the prior written consent of IHP, which consent may require payment of a re-use fee.  The Plans licensed to you cannot be resold to another individual, or used by anyone other than contractors, engineers, consultants, lenders, or governmental agencies on a “need to know” basis as reasonably required for the purpose of building a single home subject to the License.  The Plans cannot be copied or reproduced by any means unless specifically authorized through prior written consent.

Building Codes. Plans are designed to comply with the International Residential Code (IRC) and to the local codes in the region where the designer lives. Each state, county, or municipality will have its own building and code requirements, particularly in regions that may face seismic events, extreme winds, and heavy snow.  In such areas, a licensed structural engineer may need to provide necessary calculations and additional drawings.  The License granted to the user authorizes the use of the Plans by a structural engineer in order to comply with all local building codes, ordinances, regulations and requirements, including permits and inspections at the time of and during construction.

Plans purchased from IHP do not carry a stamp from a licensed architect. If this is required by your local building department, you will need to hire a local architect or engineer to review and stamp the plans before the start of any construction.

Pricing.  All pricing published on the Site is in US Dollars.  Pricing and conditions are subject to change without notice.  Due to the number of Plans and price options for Plans offered by IHP, data entry and other errors inevitably may occur in the text and pricing shown on this Site. IHP reserves the right to correct such errors as they are discovered, and no order and pricing with respect to that order shall be final until confirmed by IHP.

General. The Plans purchased on this Site are intended to indicate design intent and basic construction detailing. It is your responsibility to ensure that you have obtained the proper professional assistance to provide standard construction details and practices, which will result in a structurally sound and weatherproof finished product. Any use of the Plans, and/or modifications of the Plans, by you, builders or others on your behalf, is done at your own risk.

Any foundation plan and associated details included in the Plans are intended to serve as a basic guide for a typical foundation system. This typical foundation system is not site- or location-specific. It is recommended to have a local designer or engineer review the Plans and provide a site-specific foundation design, if found necessary.

The Plans provide ideas and concepts and are not intended to be complete in all respects and details. Variations in standard sizes (i.e., of windows and doors), and brands, thicknesses, types and uses of different materials can change details. Varying local codes, ordinances, regulations, foundation requirements, and the layout of electrical, mechanical, and plumbing systems may also require changes of details.

Shipping. Ideal House Plans, LLC (“IHP”) uses an outside shipping company to ship orders. As noted in the privacy policy, IHP shares information (such as name and mailing address) with the shipping company in order to fulfill orders.

Printed sets are typically shipped within 3 business days of receiving the order. The purchaser will be notified via email when the order has shipped and will be sent a tracking number.  

We cannot ship to Alaska, Hawaii, or regions outside the U.S.  If you live in one of these areas, please order a PDF set.

PDF sets are typically emailed within 1 business day of receiving the order.

Returns. Due to the nature of the design business, returns cannot be accepted. All sales are final.  No refunds or exchanges can be given once your order has started the fulfillment process.  In the event that IHP delivers the incorrect plan, a replacement will be sent.

Changes to these Terms. IHP may modify these Terms at any time by posting changes on the Site. Your continued use of the Site will signify your acceptance of the changes in Terms.  If there are changes to the privacy policy, an announcement will be posted on the home page that the changes have been made.  If there are changes to how the Site uses Personally Identifiable Information, notification will be sent via email to those affected by such changes.

Termination. IHP has the right to terminate these Terms, the License, and/or your right to use the Site, at our discretion, if you do not comply with any of the provisions of these Terms. Unless sooner terminated, the License shall terminate upon your completion or abandonment of the Project.

Legal

Intellectual Property Rights. IHP owns all Intellectual Property Rights on the Site, which includes any Plans or modified versions thereof; and all other graphics, including images, videos, photographs, artwork; and contents, functionality, design, and layout of the Site. “Intellectual Property Rights” means, collectively, all rights with respect to logos, trademarks, copyrights, rights of authorship; all database rights, moral rights, inventions, rights of inventorship, rights of publicity and privacy, trade secrets, rights under unfair competition and unfair trade practices laws; and all other worldwide intellectual and industrial property rights related thereto.

The Plans are protected by United States Copyright Laws; and any use of the information contained therein beyond the one-time use authorized under the License, or any reproduction, publication, sale or distribution of any part of the Plans without the prior written consent of IHP, constitutes a violation of Federal Laws, and may make you subject to prosecution and the prescribed penalties to the full extent as provided thereunder.

By using the Site, you represent and warrant that you own all Intellectual Property Rights in Your Information. By submitting Your Information, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable right and license to use Your Information in connection with the Site in ways consistent with the privacy policy.

Indemnity. You agree to indemnify and hold harmless IHP and its affiliates, officers, owners, agents, representatives, and contractors (collectively, the “Indemnified Parties”) from and against any and all losses, claims, demands, causes of action, damages, liability and costs and expenses, incurred or sustained by any of the Indemnified Parties in connection with (i) the use, construction, conversion, modification, misinterpretation, misuse, or reuse by you or others of the Plans or any other drawings, data or other materials furnished by IHP; (ii) any negligence or other acts or omissions by you or any of your employees, consultants, advisors, agents, representatives or contractors; and (iii) any breach by you of any of the provisions of these Terms. IHP reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

Disclaimer. You assume all responsibility and risk for your use of this Site, including any Plans. The Site, including any plans, is provided as-is, without representations or warranties of any kind, express or implied.  It is your responsibility to ensure, prior to use of any Plans, that such Plans are accurate, suitable for your purposes, and compliant with all applicable laws.

Limitations of Liability.  IHP shall not be liable for any indirect, consequential, punitive, incidental, special, or exemplary damages arising out of your use of, misuse of, or inability to use the Site, including any Plans.  IHP’s liability for any direct damages shall be limited to the (i) amount you have paid to IHP in connection with the matter giving rise to such liability or (ii) if you have not made any payment, the amount of $100.  If this limitation of liability or exclusion of warranty is held inapplicable or unenforceable for any reason, IHP’s maximum liability for any type of damages shall be limited to $100.
